Please read these terms and conditions carefully before using TradeKama platform. By accessing or using our services, you agree to be bound by these terms.
Acceptance of Terms
By creating an account, accessing, or using TradeKama ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you ("User," "you," or "your") and TradeKama Limited ("TradeKama," "we," "us," or "our").
If you do not agree to these Terms, you must not access or use the Platform.
Definitions
- "Buyer" - A registered user purchasing goods or services
- "Supplier" - A registered user offering goods or services for sale
- "RFQ" - Request for Quotation submitted by buyers
- "Transaction" - Any business deal facilitated through the Platform
- "Content" - All information, data, text, images, and materials on the Platform
Eligibility and Account Registration
Age and Capacity
You must be at least 18 years old and have the legal capacity to enter into binding contracts to use TradeKama. Users under 18 are prohibited from creating accounts or conducting transactions.
Business Registration
You must provide accurate, complete, and current business information including:
- Legal business name and registration number
- Valid business address and contact details
- Tax identification numbers where applicable
- Authorized signatory information
Account Security
You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify TradeKama of any unauthorized access or security breach.
User Obligations
You Must:
- ✓ Provide accurate and truthful information
- ✓ Comply with all applicable laws and regulations
- ✓ Honor all commitments made on the Platform
- ✓ Maintain professional conduct in communications
- ✓ Pay all applicable fees and charges
- ✓ Respect intellectual property rights
You Must Not:
- ✗ Provide false or misleading information
- ✗ Engage in fraudulent activities
- ✗ Manipulate ratings or reviews
- ✗ Spam or harass other users
- ✗ Violate intellectual property rights
- ✗ Circumvent platform fees
Transactions and Payments
Transaction Terms
- •All transactions are between buyers and suppliers directly. TradeKama facilitates but is not a party to transactions.
- •Buyers and suppliers must agree on prices, terms, and conditions independently.
- •Payment terms are negotiated between parties. TradeKama may facilitate payment processing.
- •Platform fees apply as per the pricing plan selected. Fees are non-refundable except as required by law.
Important Notice
TradeKama does not guarantee the quality, safety, legality, or availability of products listed. Users must conduct their own due diligence before entering into transactions.
Intellectual Property Rights
TradeKama IP
The Platform, including its design, features, trademarks, logos, and content, is owned by TradeKama and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without written permission.
User Content
You retain ownership of content you upload (product listings, descriptions, images). By uploading, you grant TradeKama a worldwide, non-exclusive license to use, display, and distribute your content on the Platform for operational purposes.
Prohibited Content
You may not upload content that is illegal, offensive, fraudulent, infringes on third-party rights, or violates these Terms.
Prohibited Activities
The following activities are strictly prohibited:
Fraudulent Activities
Scams, fake listings, payment fraud, identity theft
Illegal Products
Counterfeit goods, prohibited items, unlicensed products
Platform Abuse
Spamming, hacking, scraping, unauthorized access
Review Manipulation
Fake reviews, rating manipulation, incentivized feedback
Dispute Resolution
In the event of disputes between users, TradeKama offers mediation services but is not obligated to resolve disputes. Users are encouraged to:
- Attempt direct resolution through platform messaging
- Contact TradeKama support for mediation assistance
- Provide documentation supporting their position
- Cooperate with resolution procedures
Governing Law: These Terms are governed by the laws of Ghana. Disputes will be resolved in courts of competent jurisdiction in Accra, Ghana, unless otherwise agreed.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- •TradeKama is not liable for indirect, incidental, consequential, or punitive damages arising from platform use.
- •Our total liability for any claim shall not exceed the fees paid by you in the 12 months preceding the claim.
- •We do not guarantee uninterrupted, secure, or error-free service.
- •We are not responsible for user conduct, product quality, delivery failures, or payment disputes between users.
Account Termination
By You
You may terminate your account at any time through account settings or by contacting support. Upon termination:
- • Access to the Platform ceases immediately
- • Outstanding obligations remain enforceable
- • No refunds for unused subscription periods
By TradeKama
We may suspend or terminate your account if you:
- • Violate these Terms
- • Engage in fraudulent activity
- • Fail to pay applicable fees
- • Damage platform reputation or integrity
Changes to Terms
TradeKama reserves the right to modify these Terms at any time. We will notify users of material changes via:
- ✓ Email notification to registered address
- ✓ Prominent notice on the Platform
- ✓ In-app notification
Continued use of the Platform after changes constitutes acceptance of the updated Terms.
Miscellaneous
Severability
If any provision is found invalid, the remaining provisions continue in full force.
Entire Agreement
These Terms constitute the entire agreement between you and TradeKama regarding platform use.
No Waiver
Failure to enforce any provision does not constitute a waiver of that provision.
Assignment
You may not assign your rights or obligations without our written consent. We may assign our rights freely.
